Mortgage bankers are giving class action reform legislation a big push to help protect lenders from abusive litigation. On June 12, the House overwhelmingly approved H.R. 1115, the “Class Action Fairness Act of 2003,” by a vote of 253-170. An almost identical bill, S. 274, has been introduced in the Senate. Both bills include a plaintiff’s bill of rights, which would have new rules for written notices to class members.
