Consumer groups in California are weighing their options after the state Supreme Court handed lenders a major victory in a decision that overturned Oakland’s predatory lending ordinance. In a 4-3 reversal, the CA Supreme Court concluded that in enacting anti-predatory lending legislation in 2001, the state legislature by implication has “fully occupied the field of regulation of predatory practices in home mortgage lending,” preempting Oakland’s ordinance as a result.
